This Founder’s Pack Membership Agreement (“Agreement”) is entered into as of the date signed below between K9 Resorts Sterling, located at 11 Pidgeon Hill Dr, Sterling, VA 20165

(“Resort”), and the individual identified in the signature block below (“Member”). By signing this Agreement, Member agrees to be bound by all terms and conditions set forth herein.

1. Membership Summary

2. Eligibility & Enrollment

2.1 Limited Availability. The Founder’s Pack is a limited promotional membership available exclusively to the first 300 customers of K9 Resorts Sterling. Enrollment is accepted on a first-come, first-served basis. The Resort reserves the right to close enrollment at any time once the 300-membership cap is reached.

2.2 Per-Dog Basis. Each membership covers one (1) dog only. Members with multiple dogs must purchase a separate membership for each dog. Each dog must independently satisfy all health, vaccination, and behavioral requirements set forth in Section 5.

3. Membership Term

3.1 Duration. This membership is valid for a period of twelve (12) consecutive months beginning on the date this Agreement is signed (“Membership Term”).

3.2 Auto-Renewal. This Agreement automatically renews month to month for a period of twelve (12) consecutive months. There is no auto-renewal for year two. Upon expiration of the Membership Term, Member’s access to Founder’s Pack benefits will cease.

4. Included Services

4.1 Unlimited Doggie Daycare

Member’s enrolled dog is entitled to unlimited daycare visits during the Membership Term, subject to the following conditions:

Daycare visits must be scheduled in advance in accordance with the Resort’s reservation policies.
The dog must pass the Resort’s mandatory daycare evaluation before participating in group play.
Daycare is subject to availability and normal operating hours. The Resort does not guarantee space on any given day.
The Resort reserves the right to remove a dog from daycare at any time based on behavioral or health concerns (see Section 5).

4.2 Unlimited Luxury Boarding

Member’s enrolled dog is entitled to unlimited* boarding stays during the Membership Term, subject to the following conditions:

No single boarding reservation may exceed fourteen (14) consecutive nights, however, you can make two 14-day reservations in one month.
After a 14-night stay, the dog must check out before a new reservation may begin.
Boarding reservations must be made in advance. Availability is not guaranteed, particularly during peak and holiday periods.
A 50% non-refundable deposit may be required to hold a boarding reservation, consistent with Resort policy.
For stays of two (2) or more nights, a required bath before checkout is required.
Peak season cancellations made within 72 hours of check-in may be subject to a $200 cancellation fee, consistent with Resort policy.

4.3 Services Not Included

The following services are not included in the Founder’s Pack and will be billed separately at prevailing rates:

Bath or spa services.
Veterinary care or medication administration.
Any add-on services or upgrades not expressly listed in Section 4.1 or 4.2.

5. Health, Vaccination & Behavioral Requirements

5.0 Mandatory Evaluation. All memberships are contingent upon the enrolled dog successfully passing a behavioral and temperament evaluation conducted by the Resort prior to or at the time of the dog’s first visit. Membership fees will not be charged until the dog has been scheduled for evaluation. If the dog does not pass the evaluation, this Agreement will be void and any amounts paid will be refunded in full.

5.1 Required Vaccinations. Prior to the dog’s first visit, Member must provide current veterinarian documentation confirming the following vaccinations: Rabies, Distemper/Parvo (DHPP), Bordetella, and Canine Influenza. Vaccinations must remain current throughout the Membership Term. The Resort reserves the right to request updated documentation at any time.

5.2 Health Status. Member warrants that the dog is in good health at the time of each visit. Dogs showing signs of illness, injury, or contagious conditions will be refused entry or may be separated from other animals. Member is responsible for any veterinary fees incurred as a result of illness or injury to the dog while in the Member’s care.

5.3 Behavioral Standards. Dogs that display aggression toward staff, other dogs, or guests may be removed from group play, placed in individualized care, or refused service. The Resort reserves the right, in its sole discretion, to terminate services for any dog that poses a safety risk. In the event services are terminated because of a dog’s behavioral standards, the monthly fee will be reimbursed in full.

5.4 Daycare Evaluation. All dogs must pass Resort’s daycare temperament evaluation before participating in group daycare. Being unable to participate in group daycare does not automatically ban a dog from the Resort. Private Play and Boarding may still be available.

5.5 Aggression & Removal. If, at any time during the Membership Term, the enrolled dog develops or displays aggressive behavior toward staff, other animals, or guests, the Resort reserves the right to immediately remove the dog from the resort and terminate this membership. In such an event, the Resort will issue a refund for the most recent completed stay. No further refund of monthly fees will be provided. The safety of staff, guests, and other animals is the Resort’s highest priority.

6. Fees & Billing

6.1 Monthly Fee. The monthly membership fee is structured as follows:

Month 1: $49.00 (introductory rate)
- The first monthly payment of $49 is due upon signing this Agreement.
Months 2–12: $349.00 per dog, per month.
- Subsequent monthly payments of $349 begin on the same calendar day of the following month and continue monthly through the end of the Membership Term.

6.2 Payment Method. Member authorizes the Resort to charge the payment method on file for monthly fees on the applicable due dates. Member is responsible for ensuring that payment information remains current and accurate.

6.3 Price Lock. The introductory rate of $49.00 for Month 1 and the standard rate of $349.00 for Months 2–12 are locked in rates for the duration of the initial 12-month Membership Term and will not increase during that period.

6.4 No Rollover. Unused daycare visits and boarding nights do not roll over, accumulate cash value, or entitle Member to any credit or refund.

7. Cancellation Policy

7.1 Member Cancellation. Member may cancel this Agreement at any time by providing written notice to the Resort. Cancellation will take effect at the end of the current billing cycle. No partial-month refunds will be issued.

7.2 No Early-Termination Refund. Monthly fees already paid are non-refundable upon cancellation. Member remains responsible for all fees incurred through the effective date of cancellation.

7.3 Resort Cancellation. The Resort reserves the right to terminate this Agreement immediately, without refund of monthly fees, if Member: (a) violates any term of this Agreement; (b) the enrolled dog poses a safety risk to staff, other animals, or guests; or (c) Member engages in abusive, threatening, or inappropriate behavior toward Resort staff.

8. Non-Transferability

This membership is personal to the Member and the enrolled dog and is strictly non-transferable. Member may not assign, sell, gift, or otherwise transfer membership benefits to any other person or dog. Attempts to transfer this membership will result in immediate termination without refund.

9. Resort Policies

Member agrees to comply with all current Resort rules and policies, including but not limited to:

Late Checkout: A late checkout fee may apply for pickups after 12:30 PM.
Reservations: All visits (daycare and boarding) require advance reservation. Walk-ins are not guaranteed.
Right to Refuse: The Resort reserves the right to refuse service at any time based on the dog’s health or temperament.

The Resort may update its policies from time to time. Member will be notified of material changes.

10. Limitation of Liability & Indemnification

10.1 Care Standard. The Resort will exercise reasonable care in providing services under this Agreement. Member acknowledges that the care and supervision of animals involves inherent risks, including injury, illness, or death, that cannot be entirely eliminated regardless of the level of care provided.

10.2 Limitation of Liability. To the maximum extent permitted by applicable law, the Resort’s total liability to Member for any claim arising under this Agreement shall not exceed the total monthly fees paid by Member in the three (3) months immediately preceding the event giving rise to the claim.

10.3 Indemnification. Member agrees to indemnify, defend, and hold harmless K9 Resorts Sterling, its owners, managers, employees, and agents from and against any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from: (a) the dog’s behavior or actions; (b) Member’s breach of this Agreement; or (c) any pre-existing health condition of the dog not disclosed to the Resort.

11. General Provisions

11.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to conflict of law principles.

11.2 Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the Founder’s Pack membership and supersedes all prior discussions, representations, or agreements.

11.3 Amendments. No amendment or modification of this Agreement shall be valid unless made in writing and signed by both parties.

11.4 Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

11.5 Waiver. Failure by either party to enforce any provision of this Agreement shall not constitute a waiver of that party’s right to enforce such provision in the future.
